If, at the time of citation, you are under the age of 18 and have received a traffic citation in Stark County, your citation will be processed through Stark County Family Court. The citation is a complaint alleging a juvenile as a Juvenile Traffic Offender in violation of Section 2152.021 of the Ohio Revised Code.
After law enforcement has issued the citation, it is sent to the Stark County Prosecutor's Office for review. This review allows the Prosecutor's Office to make a recommendation to the Court as to the informal or formal processing of the allegation. The Court receives the Prosecutor's recommendation and makes a final case processing determination. This determination is based upon criteria established by the Family Court Judges.
Informal Processing
Traffic Diversion Program
Eligibility for the Traffic Diversion Program means the citation and driving history of the juvenile meets the Judges' established criteria to allow the citation to be processed through the Traffic Diversion program. An Intake Officer will discuss with the juvenile and parent/legal guardian, the requirements necessary to successfully divert the traffic offense. A successfully diverted traffic offense allows the case to be dismissed. If the requirements are not completed by the established end date, the case will proceed formally.
Formal Processing
Court Appearance
If your citation and/or driving history does not afford you the opportunity of diversion; you fail to respond to the Diversion Conference Notice; or you fail to meet Diversion Program requirements you will be summoned to appear in court. Your summons will be sent via US mail, and it will contain the date and time of your scheduled hearing. A parent/legal guardian must be in attendance with you at your hearing.
